1. Our Commitment
Uphoff Country Kennel is committed to providing a healthy, well-socialized puppy. All puppies are current on age-appropriate vaccinations and deworming at the time of sale. Uphoff Country Kennel will provide the Buyer with complete medical history and vaccination records at the time of purchase.
2. Health Certification at Sale
Uphoff Country Kennel certifies that, to the best of their knowledge, the puppy is in good health and free of obvious illness or defects at the time of sale. The puppy has received all vaccinations and deworming treatments appropriate for its age.
3. Buyer’s Responsibilities – Veterinary Examination
The Buyer agrees to have the puppy examined by a licensed veterinarian (of the Buyer’s choice) within three (3) business days of taking custody (excluding Sundays and holidays). Appointment Date ________________________
- If the puppy is not examined within this period, all health guarantees become void.
- If a health issue is discovered during this initial exam, the Buyer must notify the Breeder immediately.
4. Health Guarantee – Congenital Defects
Uphoff Country Kennel guarantees the puppy to be free of life-threatening congenital (genetic/hereditary) defects for one (1) year from the puppy’s date of birth.
- If a licensed veterinarian diagnoses a life-threatening congenital defect within this period, the Buyer must:
- Provide proof of the initial veterinary exam within the first three (3) business days.
- Notify Uphoff Country Kennel in writing within seven (7) days of the diagnosis.
- Uphoff Country Kennel has the right to require a second opinion from a veterinarian or specialist of their choice (Uphoff Country Kennel’s expense).
- If a life-threatening congenital defect is confirmed, Uphoff Country Kennel will offer a replacement puppy of equal or lesser value (from a future litter) within up to 24 months. Color, sex, and exact markings are not guaranteed.
- If the Buyer declines a replacement puppy, the sale is considered final with no refund or further remedy.
5. Exclusions from Health Guarantee
This guarantee does not cover minor or non-life-threatening conditions, including but not limited to:
- Umbilical hernia
- Inguinal hernia
- Cherry eye
- Undescended testicle(s)
- Underbite or overbite
- Grade 1–2 heart murmur
- Grade 1–2 patellar luxation
- Infectious/parasitic conditions (e.g., hypoglycemia, coccidiosis, kennel cough, giardia, mites, fleas, ticks, ringworm, ear infections, worms)
- Any illness or injury due to ingestion of foreign objects, food, chemicals, toxins, or physical trauma
- Any condition resulting from failure to keep vaccinations current
6. General Disclaimers
- The Buyer is solely responsible for maintaining all future vaccinations, preventive care, and overall health after the sale. Failure to do so voids the health guarantee.
- Uphoff Country Kennel assumes no responsibility after the date of sale/adoption for: medical expenses, disease, death, landlord issues, allergies, shedding, personality/temperament, training difficulties, family disagreements, or any other matters not directly related to a covered life-threatening congenital defect.
- No refunds will be issued under any circumstances.
- It is strongly recommended that the puppy avoid contact with other dogs or high-risk environments until fully vaccinated.
- No other warranties or guarantees (expressed or implied) are provided except as explicitly stated in this agreement.
- This health guarantee is non-transferable and applies only to the original Buyer.
7. Non-Breeding Agreement
The puppy is sold strictly as a pet/companion with no breeding rights. The Buyer agrees not to use the puppy for breeding purposes under any circumstances. Violation of this clause may result in legal action to enforce the terms.
